Is "Snow Emergency" Legally Valid?

We're in the grip of our first snow emergency of the 2013-2014 winter. Winter Storm Cleon. With Dion already following closely.

Now, this isn't about what makes a snow emergency in any specific place. Minnesota and North Dakota would probably laugh at what Cincinnati calls an emergency.Maybe even at what they would call a significant snowfall.

But, the fact is, Cincinnati communities are calling snow emergencies of various levels.

Big whooping deal. It means, for the most part, that communities can write tickets and write off damage to cars parked on the streets.

They say not to go out unless absolutely necessary.
But who decides what is necessary?

I can tell you who does NOT decide.
Service industry workers. They have to go to work or lose their jobs.
The owners of various businesses don't care much if the police say don't go out.
The police don't care much, either. If you are driving slowly and carefully, they aren't likely to chase you down and possibly cause an accident, as well as keeping you both out when you could be getting in somewhere.
But the gas stations HAVE to stay open.
McDonald's MUST stay open.
Facilities such as hospitals and nursing homes, by their very nature, need to stay open. But must they insist on workers coming in in a "snow emergency"?
(I don't know what they could do instead. They should work up snow emergency protocols. Reduced staff, maybe sleep-breaks for people who will remain instead of go out I believe some hospitals do do that.)

Not only do these businesses insist on insisting, they punish those who don't risk life and limb to serve coffee to idiots. (Road personnel excepted from this category.) They write them up(disciplinary action); they brand them as unreliable; they reduce their hours; they even fire them.
They do not pay the fines for tickets received.
They do not pay for damages caused by an accident when their employees should never have been on the road in the first place.
They do not compensate for extra gas burned in longer, slower drives.
They don't pay hospital bills for slip and slide crashes.
They do NOT pay for funerals.

It's not just the service industry. There are factories with this same mindset. Never mind that their product is nonessential -- they have quotas that must be met, come hell or high water. (Hell or high snowdrifts?) The work must be done.

No mere employee can protest any of these disciplinary actions by pleading a snow emergency. The designation has no standing in labor law.

So, a "Snow Emergency" is a money maker for the municipality.
A "Snow Emergency" is an out for insurance companies, who will not pay (easily) for an accident caused when the driver wasn't supposed to be driving.
A "Snow Emergency" is no reason to not go out; thus says American Industry.

So, I ask you, why bother.
Why bother?

They keep coming, and we can't stop it

The damn tornadoes, that's what I'm talking about. Out in Oklahoma, throughout the whole region, they just keep coming.
And there's not a damned thing anyone can do to stop them, or avoid them, or do anything but stand by helplessly while Mother Nature runs her vacuum.
Afterwards, yes, we CAN, and should, and DO rush in to help. It's what we'd hope for, were we the victims.
And we could indeed be the victims, anywhere, any time, any one of us.

Tornadoes are less a regional phenomenon than some disasters. Hurricanes hit shorelines, floods occur near rivers, mudslides are usually in hill country (slide implying gravity), forest fires happen in forests.
Tornadoes, like earthquakes, can happen anywhere.
Therefore, they can happen to you.

Now, they do have preferred playgrounds, like the Great Plains for tornadoes and the San Andreas in California, but they can happen anywhere.

The one advantage in the Plains is that usually one can see (if one is looking) from miles away and hopefully take shelter before the twister gets to you.

Last night, because of heavy rains, many, many people could not see because of the heavy rains and the preternatural darkness of the storm. Many, many people are today still shaking, still fearful, and still looking for loved ones. I hope that everyone locates one another, and that losses stay low. I wish that no one would die in these horrific storms, but that has already happened, and there's nothing I can do to change it.

I wish I could.

I haven't had a close encounter with a twister, although members of my family have. Heck, I have a brother in Kansas. My sister played tag with one last spring.(She won.)A long time ago, one collapsed my grandfather's barn. Then there was the Thanksgiving tornado, mid 90s. I went outside because it was so hot and humid, and heard the trains about a mile away, cane inside and said, "It's still and sticky, and I heard a train. Think we should hide?"
A tornado took down a garage and damaged some trees approximately a mile away.

I still shake at the memory.
The Menace that roars out of the night.
Out of the nowhere.

I can't help you, Oklahoma. Not in the preventive, sheltering, protecting ways you are so in need of.
I wish I could.
I will do what I can to help afterwards, but it will never be enough. It can never be enough.
And there's always going to be guilt that I can be so grateful it wasn't me or mine, and I feel bad about that, too.

Because I know it could have been.
May someday be.
It's good to know you will understand, if that time ever comes.

But for now, I think we would all like to put this into the past.

We are trying to help do just that.

Lower the numbers; raise the profits

This is the latest strategy of the health industry. Everybody is sick and needs us -- and our products. Whenever the numbers start to decrease, we'll go back into our laboratories and jiggle some statistics around and we can PROVE that a lower number for the same high-number illness is just as bad for you. Therefore, the lower number indicator means you have the higher number illness and you MUST have our medicine to survive.

I've seen this happen with hypertension. It happens every few years. People, I am sorry to tell you this, but no one has normal blood pressure anymore. It is either low or high, according to the professional experts. The parameter for normal has become so narrow as to be nonexistent.

It's been happening about every five years with diabetes. Numbers that were low-normal just a few years ago are now borderline high. Diabetes can now be diagnosed by one high reading in a doctor's office, instead of making a patient undergo that intolerable glucose tolerance test, or instead of tracking the blood sugar levels over an extended period of time.

I read a study yesterday that says that  "over 60% of people are obese"

Now, I'm not a scientist, nor have I studied health. Another thing I am not is a math genius. But I vaguely remember things about averages and norms and suchlike. When something is in the 60% range, that, mathematically, means it's pretty much the average, the norm.

Just because someone educated drew a line on a paper and said everyone above this line is sick doesn't mean they are. 

There are still doctors who go by the older numbers if their patients aren't in distress. They are few and far between and often work in isolated, rural areas. They don't go along to get along with the insurance companies. They ask "Why?"
When they ask "Why?" they become estranged and ostracized.

They generally don't want to practice that kind of medicine anyway, so they go to where they are over-needed and where they are listened to.


What really bothers me about medicine by the numbers is that it leaves out the element of change. Evolution, or mutation, or whatever you want to call it. Humans began as five-foot tall bipeds who could live thirty years.

Science and scientists have had no problem with embracing our growth and evolution from that standard.
Imagine if some nearsighted observer in the Whatever-ithic era said that anyone over 5'2" was an aberration, and had an illness and needed to be treated for it. Maybe had the afflicted eating weeds known to stunt the growth. Would we still be five foot and old at thirty?

No, we would not. Change and growth are not aberrations. At first as those numbers begin to trickle in, they are an anomaly, and yes, worthy of study. Worthy of tracking. Maybe even worthy of treatment, until it reaches the point where there are more 'anomalies' than there are 'normals'.

Once that point is reached, it is the duty of responsible scientists, researchers, and statisticians to take another look at a new definition of normal, a new average. Not to hit the panic button and start name-calling those they are trying to help.

We're not getting sicker -- we're getting different. We're changing, evolving, mutating.

We are growing.

A Rousing Good Whatchacallit.

I love to debate. I love to argue. I sometimes love to take an opposing view on a topic just to rile someone. Or to try and figure out where I do stand on an issue. Or to find out where the gaps in knowledge are -- mine as well as theirs.

Because I like to learn. I like to know. I like to think, and I like to see others thinking and learning.

Sometimes the same subject will come up again. Sometimes because the person on the other side doesn't leave things alone. More often because something new has come to light and needs to be examined, taken apart, checked out, cleaned up and put back together again. The best way for me to do that is to be arguing (debating) with someone about it.

A debate is a good way to find out where you don't have any answers, or that the answers you have may be inadequate. After all, there is no one like a sibling to say "nyah, nyah, you don't got an answer." Or a friend who will say, "But why not?"

Hyperbole, of a sort, can play into this type of debate. I will sometimes make a grand, broad statement, then sit back to see how people react. I think I know how this one will, or what that one will say, but much more often, I am proven wrong in my expectation. I like that.

Hyperbole can draw attention to a topic, too. Sometimes, saying something wrong can get people talking. To you, asking or telling you about your wrongness. Sometimes to one another, about how wrong you can be, and how you got that way.

So don't be afraid of argument, discussion, debate. It will keep fresh winds blowing through your brains. It will help you see 'old' friends and family in a new way.

It will keep you lively, and alive.

I am my Appliances.

I have to say, there seems to be something to the idea that household appliances last ten years before they need replaced. I've finally owned major appliances, purchased new, that have lasted ten years. And, true to statistics, they have started to break down.

My dryer makes a horrible noise. I don't know if it works at all or not (the drum will turn sometimes), because that very strange, very loud noise makes me afraid to find out. I don't want the thing to explode, after all. Or catch on fire. Or put out power for the whole town. Anyway, that's the dryer.

Then the heating element in my oven went out. This has happened before, and isn't really a big deal, except that it happened. It's frustrating. Last night, one of my burners caught on fire. It's a burner I've used infrequently but regularly, and there was no reason for it to ignite. It was not on high heat. Scorched and burned one of my brand new beautiful red pans, too.

That leaves the refrigerator and the washer. The washer has had problems for a long time. Nothing major, nothing unexplainable, nothing impossible. It cleans my clothes, as long as the necessary adjustments are made.
Haven't had too many problems with the fridge. It wants to freeze everything on the top shelf, or nor quite freeze things in the freezer, and there's a shelf in the freezer that is at the wrong level and it wont come out. But other than that, it cools on. (I hope I'm not jinxing it by talking about it.)

This all reminds me, strongly, of what happened to my body once I turned forty. I started having accidents like stepping in a hole and falling up stairs and smacking the back of my hand into bread racks. After the accidents, the remnants -- the places that I had injured -- just started aching, often for no reason.

But, like my appliances, I'm still here.
I'm still doing my job(s).
There have to be adjustments, there has to be timing, and things may be done differently. But the jobs can be done or got around.

We'll all  work on until completely dead, and even that may not be "The End".

We (me and my appliances) can be harvested for parts when our usefulness as ourselves is over.
That's a nice thought.

Should RDA be RYA?

The experts are quick to blame our expanding waistlines and backsides on a lot of things, including sedentary lifetimes and overprocessed foods.

It never seems to occur to them that it may be their advice that's stuffing us.

Some commercials once came close to addressing this problem, showing people pulling and tugging overloaded groceries carts of broccoli commenting about how much of this you have to get to get the RDA (Recommended Daily Allotment) of a specific nutrient.

The truth is, no one can get ALL the RDA nutrients, even if they eat all day every day and eat only 'good' food.

The RDA is something created by statisticians. In some laboratory somewhere, after months and years of study, it was discovered that if people eat nutritionum monthly, they won't fall ill fron nutritionum deficiency. However, a medium sized person has to ingest a medium sized portion. One applies math and realizes that this amounts to 30portion sizes per pound (pspp). If you extend the math out, that means that in a month, the person needs 1 pspp per day. Then the body won't have to store anything, if you just eat your 1 pspp per day.

They are forgetting that the human body was made to store nutrients. That's what's making us all fat. Our bodies just keep on doing their job no matter how hard we make them work to do so.

Let's forget RDA. If we can't do it right away, maybe we can try for RWA -- a weekly dose of what we don't need every day.

Humans are adapted -- or were -- to live in a seasonal world. Fruits in the summer, veggies whenever they can be found, meat when it is available. Many a person living some form of vegetarianism will tell you -- you don't need all that 'stuff'\.' You don't need vitamins if you eat right.

If you do eat by the charts, even cutting out fats and processed foods, you will still get fat and your body will still take early retirement because of overwork.

Don't eat well -- eat REAL.
And heal.
